If you intend to go that route, you can argue that your employer engaged in a tort called conversion, and if you prove that, you will be entitled to the fair market value (not the purchase new value) of the property lost. It is unlikely any employment law attorney would take such a case, leaving you with small claims court to seek redress. More significantly, unless you left very valuable items in the locker, the case will have little value. Regardless of how the lockers have been handled in the past, if you were placed on notice that the employer can acts as it did, you are going to have a hard time winning a case. For instance is there a written policy in your employee handbook or elsewhere that describes employee use of the lockers. I explained to her that I’ve had the same locker for 4 years and that it was assigned to me by the mansion at the time. At the end of my shift, I reached out to my manager and supervisor, which she said she didn’t know what I was talking about, that she had cleared all lockers that were not assigned. I asked my manager what happened to my belongings, said he was not sure, it might have been the supervisor. When I started my shift, I noticed my locker was being used by someone else. I usually work only one day out of the week due to being part time and having a second full-time job. ![]()
